dc.description.abstractArtykuł omawia zasadę domniemania niewinności, przedstawiając jej definicję, zakres oraz funkcje. Przedstawia historyczny rozwój domniemania niewinności, poczynając od prawa rzymskiego, następnie przez średniowiecze, nowożytność, oświecenie, aż do chwili obecnej. Opisuje proces kształtowania się zasady domniemania niewinności w Polsce przedrozbiorowej, w okresie rozbiorów i po odzyskaniu niepodległości. Autor podkreśla, że polski prawodawca czerpał z dorobku kultury prawnej, co przyniosło pozytywne skutki w postaci uregulowania zasady domniemania niewinności w kodeksie postępowania karnego z 1969 roku (art. 3 § 2) i z 1997 roku (art. 5 § 1), dostosowując je do uregulowań zawartych w aktach prawa międzynarodowego, których Polska jest stroną.pl
dc.description.abstractThe article discusses the principle of presumption of innocence, providing its definition, scope and function. It presents the historical development of the presumption of innocence, beginning with Roman law, then through the Middle Ages, the Modern Era, the Enlightenment and up to the present day. Describes presents the process of formation of the principle of presumption of innocence in pre-partition Poland, during the period of partition and after independence. The author emphasises that the Polish legislatordrew on the achievements of legal culture, which had the positive effect of regulating the principle of presumption of innocence in the 1969 Code of Criminal Procedure (art. 3 § 2) and the 1997 Code of Criminal Procedure (art. 5 § 1), bringing it into line with the regulations contained in acts of international law to which Poland is a party.en
